These Terms and Conditions set out the basis on which Rubbish Removal Finsbury Park provides rubbish removal, waste collection and related services to residential and commercial customers in the United Kingdom. By booking our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, references to we, us and our mean the rubbish removal service provider trading under the name Rubbish Removal Finsbury Park. References to you and your mean the customer placing an order for our services, whether as an individual, business, landlord, agent or other organisation.
1.1 We provide rubbish removal, waste clearance, bulky item collection, and related loading and transport services from premises and locations within our service area, including Finsbury Park and surrounding districts. Our services are limited to the removal of waste that you are legally entitled to dispose of and that complies with applicable waste regulations.
1.2 Our standard service includes the collection, loading and transportation of agreed waste materials from the collection point at your premises or site to an authorised waste transfer station, recycling facility or disposal site. Unless expressly agreed, our services do not include dismantling of structures, specialist cleaning, or removal of fixtures and fittings.
1.3 We reserve the right to refuse to remove any items that we reasonably believe are hazardous, illegal, excessively heavy, unsafe to move, infested, contaminated, or otherwise unsuitable for collection with the equipment and resources available on the day.
2.1 You may request a booking by telephone, email, online form, or other authorised booking method specified by us from time to time. When you make a booking request, you must provide accurate and complete information about the type, quantity and location of the waste, access conditions, and any relevant restrictions such as parking or building rules.
2.2 Based on the information you provide, we will give you an estimate or quotation for the service. This may be a fixed price, a price range, or a price based on volume, weight, time on site, or other clear pricing criteria. All quotations are given in good faith but are not binding if the information you supplied is inaccurate or incomplete.
2.3 Your booking is not confirmed until we have accepted it and provided you with a booking confirmation, which may be sent by email, text message or given verbally and recorded in our booking system. We may decline a booking at our discretion, including where we do not have capacity, where access is unsuitable, or where we consider the waste to be outside our normal service scope.
2.4 You are responsible for ensuring that someone with authority to approve the work is present at the property at the agreed time, unless we have agreed in advance to collect the waste in your absence. If you will not be present, you must provide clear instructions and ensure safe access to the waste.
3.1 The price you pay will normally be based on the quotation or pricing structure agreed at the time of booking, subject to any adjustment required on site if the actual waste or conditions differ materially from those described in your booking request.
3.2 We will inform you of any change to the estimated price before commencing the work, where reasonably practicable. If you do not agree to the revised price, we may cancel the service or agree to remove a lesser amount of waste for the original agreed price where that is feasible.
3.3 Unless otherwise agreed in writing, payment is due in full on completion of the collection service on the same day. We accept the payment methods that we notify to you, which may include cash, card payment, bank transfer or other electronic payment methods in use at the time.
3.4 For business and account customers, we may agree alternative payment terms, such as payment on invoice within a specified period. Where such terms apply, they will be set out in separate written arrangements or in an account agreement. We reserve the right to carry out credit checks and to require upfront payment, a deposit, or staged payments where we consider this appropriate.
3.5 If you fail to pay any amount due to us by the required date, we may charge interest on the overdue amount at the statutory rate permitted under UK law, and you will be responsible for any reasonable costs we incur in seeking to recover sums owed, including enforcement and legal costs.
4.1 You may cancel or amend your booking by contacting us as soon as possible during our normal business hours. We request at least 24 hours’ notice for cancellations or significant changes to the booking details, including changes to the date, time, address, or volume of waste.
4.2 If you cancel with at least 24 hours’ notice before the scheduled arrival time, no cancellation fee will normally be charged. If you cancel with less than 24 hours’ notice, we reserve the right to charge a reasonable cancellation fee to cover our costs, including lost time and allocated resources.
4.3 If we arrive at the agreed time and are unable to carry out the service for reasons within your control, including but not limited to lack of access, absence of an authorised person when required, incorrect address, parking restrictions not disclosed in advance, or the waste not being available, we may charge a call-out fee or a portion of the quoted price.
4.4 We may cancel or reschedule your booking where we are unable to carry out the service due to reasons beyond our reasonable control, including vehicle breakdown, severe weather, traffic disruption, staff illness, unsafe working conditions, or changes in legal or regulatory requirements. In such circumstances, we will use reasonable efforts to notify you and offer a new appointment time. We will not be liable for any indirect or consequential losses arising from such cancellation or rescheduling.
5.1 You must ensure that we have safe, reasonable and lawful access to the collection point, including appropriate parking or stopping space for our vehicle. You are responsible for securing any necessary permits, permissions or authorisations required for us to park or enter your premises, unless we expressly agree to obtain such permissions ourselves.
5.2 Waste intended for collection should be clearly identified, separated from items not to be removed, and located in an accessible area. If there is any ambiguity about which items are to be taken, you should clearly indicate these to our staff on arrival.
5.3 You must not ask our staff to remove items that are illegal to transport or dispose of, that you do not have the right to discard, or that are prohibited under applicable waste regulations. You must disclose any items that may be hazardous or require special handling.
5.4 You are responsible for ensuring that any personal data, confidential documents or valuable items have been removed from the waste prior to collection. Once items have been loaded into our vehicle, they are deemed to be waste and cannot be returned.
6.1 We operate in compliance with relevant UK waste management legislation and regulations. All waste we collect is transported only to licensed or authorised facilities, and we seek to recycle or recover materials wherever reasonably practicable.
6.2 We may be unable to collect certain categories of waste, including but not limited to asbestos, clinical or medical waste, certain chemicals and solvents, pressurised containers, explosive materials, radioactive substances, or other specialist or hazardous wastes requiring specific permits or equipment. You should contact us in advance if you are unsure whether your waste is acceptable.
6.3 If hazardous or prohibited waste is discovered among the materials to be collected, we may refuse to proceed with the collection in whole or in part. Where we have already incurred costs or time on site, we may charge a proportionate fee for the visit even if the collection cannot be completed.
6.4 Upon collection, the waste becomes our responsibility as the waste carrier. We will handle and dispose of it in accordance with applicable laws, including the duty of care for controlled waste. We may issue a waste transfer note or other documentation where required.
7.1 We will exercise reasonable care and skill in providing our rubbish removal services. However, we are not liable for any loss or damage arising from inaccurate or incomplete information you provide, from your failure to comply with these Terms and Conditions, or from circumstances beyond our reasonable control.
7.2 While our staff take reasonable care when moving items through your property, minor scuffs or marks to walls, floors or door frames can sometimes occur, especially in tight or difficult access areas. We are not liable for normal wear and tear or superficial damage that could not reasonably be avoided when moving bulky or heavy items.
7.3 You must inform our team immediately if you believe any significant damage has been caused by our actions during the collection. We may ask you to provide photographs and a written description of the incident. Failure to notify us within a reasonable time may affect our ability to investigate and may limit any potential remedy.
7.4 Our total liability to you for any loss or damage arising out of or in connection with our services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall be limited to the total amount paid or payable by you for the specific service that gave rise to the claim, except where such limitation is not permitted by law.
7.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to exclude or limit liability under UK law.
8.1 We maintain public liability insurance and other insurance cover appropriate to the nature of our rubbish removal operations. Details of our insurance cover are available on request.
8.2 You are responsible for ensuring you have adequate insurance in place for your property and contents. Our services are not a substitute for contents, buildings or business interruption insurance that you may require.
9.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible, providing full details of your concerns. We will investigate the matter and aim to resolve complaints promptly and fairly.
9.2 Where a dispute arises that cannot be resolved directly between you and us, both parties agree to consider reasonable methods of alternative dispute resolution before resorting to court proceedings, where appropriate and proportionate to the nature of the dispute.
10.1 We collect and process personal information that you provide in connection with bookings and service delivery, such as your name, contact details, address and payment information. We handle your personal data in accordance with applicable UK data protection laws.
10.2 We use your information for the purposes of managing your booking, providing our services, processing payments, responding to enquiries, and, where permitted, sending you information about our services. We will not sell your personal data to third parties.
10.3 We may share your personal data with trusted third parties who assist us in providing our services, such as payment processors or IT service providers, but only where necessary and subject to appropriate safeguards.
11.1 We may update or amend these Terms and Conditions from time to time, for example to reflect changes in law, regulations, or our operating practices. The latest version will apply to all new bookings made after the revised Terms and Conditions come into effect.
11.2 If we make significant changes that materially affect existing bookings, we will take reasonable steps to notify affected customers and will give you the option to cancel your booking without penalty if you do not wish to proceed under the revised terms.
12.1 These Terms and Conditions and any disputes or claims arising out of or in connection with them, or with the provision of our rubbish removal and waste collection services, shall be governed by and construed in accordance with the laws of England and Wales.
12.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, except where mandatory law gives you additional rights to bring proceedings in another jurisdiction.
13.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will continue in full force and effect.
13.2 No failure or delay by us in exercising any right or remedy provided under these Terms and Conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.
13.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations at any time, provided that this does not reduce your rights under these Terms and Conditions.
13.4 These Terms and Conditions, together with any quotation or booking confirmation, constitute the entire agreement between you and us relating to the provision of rubbish removal and waste collection services in our service area and supersede any prior discussions, correspondence or understandings.
We will remove waste materials straight from your home and transfer them to be recycled or disposed of. You will be provided with a free quote to know precisely how much you will save.
